Lower Kootenay Band arbitration set to begin

An arbitration hearing today will decide the future of the Lower Kootenay Band council’s make-up.

In January the council received a petition signed by 30 band members seeking the removal of chief Jason Louie and councillor Sandra Luke.

The arbitrator will assess the validity of the signatures and determine if it’s conclusive evidence the membership has lost confidence in Louie and Luke.

The band council says it will abide by whatever the arbitrator decides.

It follows a 2015 BC Court of Appeal ruling that found that a past band council, which Louie and Luke were a part of, breached their fiduciary duty.

The case was brought by Louie’s uncle Wayne.

The hearing is at the Creston Ramada starting at 9 a.m.
