Arbitrator to decide band chief’s fate

An arbitration hearing next month could result in the removal of the Lower Kootenay Band’s chief.

Wayne Louie has brought the action against chief Jason Louie, who is his nephew, as well as councillor Sandra Luke.

Wayne Louie says it’s part of a long-running dispute that’s already been through the courts.

But Jason Louie, who has been chief since 2010, says he stands by his record.

The hearing is Feb. 21 at the Ramada in Creston.

The BC Court of Appeal ruled that the band council breached its fiduciary duty by awarding themselves $5,000 bonuses in 2009.

The money was part of $125,000 received to provide the Regional District of Central Kootenay access to their landfill site through the band’s property.
